What documents are required in a driver qualification file?
49 CFR Part 391 requires: the driver's employment application, motor vehicle records (MVR) from each state where licensed, road test certificate or equivalent, medical examiner's certificate, annual MVR review, annual driver certification of violations, and any skill performance evaluation certificates. Missing any item is a violation during a DOT audit.
How long must I keep driver qualification files?
Keep the file for the entire employment period plus 3 years after the driver leaves. Some items have shorter required retention — medical certificates must be kept 3 years, and annual reviews for 3 years — but safest practice is retaining the complete file for employment + 3 years.
Do owner-operators need a driver qualification file on themselves?
Yes. If you operate under your own DOT authority, you must maintain a complete qualification file on yourself — same documents as any employed driver. This is one of the most commonly missed requirements for single-truck operators.
What happens if my DQ file is incomplete during an audit?
Missing or expired DQ file items are among the most common violations in FMCSA compliance reviews. Each missing document can be cited separately, contributing to a conditional or unsatisfactory safety rating — which affects insurance rates and broker contracts.
